VENICE – Owners of waterfront properties used by the Freedom Boat Club in Venice will ask Venice City Council to assert their right to build multi-family homes on about one-third of an acre at 996 Laguna Drive.

The plot is at the intersection of Laguna Drive, The Esplanade North and Tarpon Center Drive.

Venice City Council will rule on the grandfather claim when it meets at 9 a.m. on Tuesday at Venice City Hall, 401 W. Venice Ave.

The property, purchased in 2013 by Gulf View Marina Holdings LLC, has a general commercial classification and is designated as commercial on the city’s future land use map.

Prior to the adoption of the last long-term growth plan in 2017, the property was designated Tarpon Center / Esplanade, with the right to request a special exception to build up to 18 units per acre – so theoretically the owners could in build up to six. residences on the ground.

The land use map in the city’s most recent growth plan identifies the parcel as a type of commercial land that would not allow further residential development.

Because of this, city staff have determined that multi-family development is not allowed there by special exception, attorney Jackson Boone noted in the cover letter of his client’s petition request.

“Gulf View Marina has relied in good faith on the fact that the adoption of the city’s new master plan in 2017 would not remove its property rights held under the city’s CG zoning district,” wrote Boone. “Since purchasing the property in 2013, Gulf View Marina has proactively explored the redevelopment of the aging and deteriorating building therein.

Boone later added, “This submission of our grandfather petition is made under protest and does not constitute an agreement that the possibility of continuing the exceptional use of multi-family housing has been removed from the property.

“We reserve all of our rights to continue this exceptional use of the property. ”

According to the Sarasota County Property Appraiser website, the structure was built in 1991 and the property includes 17 parking spaces, 20 boat spaces, and a 200 square foot detached garage.

Since Gulf View filed for grandfathering, the city has received several opposition emails – all from owners of Casa Seville, a four-story, 56-unit condominium across the street at 995 Laguna Drive. .

Residents cite concerns ranging from congestion and flooding to safety and obstructed views of properties.
